Terms and Conditions
1) Acceptance of Terms and Website Use
By accessing this website, submitting an enquiry, creating an account, or purchasing any product or service through the site, you agree to these Terms and Conditions, together with any policies referenced on the website (including our Return Policy and Privacy Policy). If you do not agree, discontinue use of the website.
You agree to use the website lawfully and responsibly. Prohibited conduct includes attempting to gain unauthorised access to systems, interfering with site performance, introducing malicious code, scraping content without permission, or misusing forms, emails, or contact details published on the website.
We may update these Terms and Conditions from time to time by publishing revised terms on this page. Changes apply from the date of publication.
2) Product Information, Quotes, and Availability
We aim to keep product descriptions, technical details, imagery, and pricing accurate. Some images are illustrative and may differ from supplied items, including packaging, branding, or minor product revisions.
Stock availability can change without notice. Adding items to a cart does not reserve stock. Orders and enquiries remain subject to confirmation.
Quotes and Errors
Written quotations (where issued) remain valid only for the period stated on the quote. If no validity period is stated, the quote may be withdrawn or updated due to exchange rates, supplier pricing, availability, or specification changes.
We reserve the right to correct errors in product information, pricing, or specifications. If a correction affects an order, we may contact you to reconfirm, amend, or cancel and refund the affected item.
3) Orders, Pricing, and Payment
Pricing
Prices are shown in the currency displayed on the website and may be inclusive or exclusive of VAT depending on what is stated at checkout or on the invoice. Delivery, installation, commissioning, offloading, site requirements, and specialised lifting equipment are excluded unless expressly included in writing.
Order Acceptance
Orders are subject to acceptance and verification. An order confirmation or automated email does not guarantee acceptance. We may decline or cancel orders where:
- Payment is not authorised or does not clear
- Products are out of stock or discontinued
- Pricing or product data is incorrect due to a system or human error
- Fraud, misuse, or abnormal ordering patterns are suspected
Payment
Payment must be made using approved methods displayed at checkout or agreed in writing for account customers. Orders are released for dispatch only once cleared funds reflect, unless otherwise agreed in writing.
Account terms, credit limits, and settlement periods apply only where confirmed in writing. Late payment may result in order delays, suspension of supply, or recovery action, subject to applicable law.
4) Delivery, Collection, and Risk
Delivery timelines are estimates unless confirmed in writing. Delays may occur due to courier constraints, supplier lead times, customs clearance, load-shedding impacts, weather events, strikes, or other circumstances beyond our reasonable control.
Inspection on Delivery
Customers must inspect goods promptly upon receipt. Any visible shipping damage, shortages, or incorrect items must be reported within the timeframes stated in our Return Policy or delivery documentation, together with photographs and delivery note references where possible.
Risk and Ownership
Risk of loss or damage generally passes to the customer upon delivery to the address provided, or on collection if collection is selected, unless the Consumer Protection Act requires otherwise in a specific transaction.
Ownership of goods remains with us until payment is received in full and cleared.
5) Returns, Warranties, and Consumer Protection (CPA)
Returns and exchanges are managed in line with our Return Policy, read together with the Consumer Protection Act, 2008 (CPA) where it applies.
CPA Considerations
Where the CPA applies and goods are defective, unsafe, or not fit for purpose, customers may have statutory remedies. Certain remedies under the CPA can apply within defined periods and subject to the nature of the goods and how they were used. Nothing in these Terms is intended to unlawfully limit consumer rights under the CPA.
Warranty Terms
Manufacturer warranties apply where offered and are subject to:
- correct installation and commissioning
- proper use within specifications
- routine maintenance aligned to product requirements
- no unauthorised modifications or repairs
Warranty claims may require inspection, documentation, and return of the product or component for assessment. Consumables and wear parts may be excluded from warranty coverage unless a manufacturing defect is confirmed.
Limitation of Liability
To the maximum extent permitted by South African law, we are not liable for indirect or consequential losses, including loss of profit, production loss, downtime, project delays, penalties, or labour costs. Our total liability relating to a specific order is limited to the amount paid for the product(s) giving rise to the claim, unless the CPA or other applicable law requires otherwise.
6) Intellectual Property, Privacy, POPIA, and Governing Law
Intellectual Property
All content on this website, including text, product listings, images, documents, logos, and layout, is owned by or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, or exploit website content for commercial purposes without prior written permission.
Privacy and POPIA
Personal information is handled in line with our Privacy Policy and South Africa’s Protection of Personal Information Act, 2013 (POPIA). We use reasonable safeguards to protect personal data and process information only for lawful purposes connected to providing products, services, support, and communication.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute will be subject to the jurisdiction of South African courts, unless applicable law provides otherwise.
